SC/ST ಮೀಸಲಾತಿ ಹೆಚ್ಚಳ ರದ್ದು: ಬಿಜೆಪಿ ಸರ್ಕಾರದ ಅವಸರದ ತೀರ್ಮಾನವೇ ಇದಕ್ಕೆ ಕಾರಣ.. ಮಾಜಿ ಸಿಎಂ ಸಿದ್ದರಾಮಯ್ಯ

ಪರಿಶಿಷ್ಟ ಜಾತಿ ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡಗಳಿಗೆ ಮೀಸಲಾತಿ ಹೆಚ್ಚಳದ ನಿರ್ಧಾರವನ್ನು ರದ್ದುಗೊಳಿಸಿದ ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್‌ ತೀರ್ಪು, ಹಲವು ತಲೆಮಾರುಗಳಿಂದ ಸಮಾನ ಅವಕಾಶ ವಂಚಿತವಾಗಿದ್ದ ಶೋಷಿತ ಸಮುದಾಯಗಳ ಘನತೆಯ ಬದುಕಿನ ಕನಸಿಗೆ ಘಾಸಿಯುಂಟುಮಾಡಿದೆ.

ನ್ಯಾಯಾಲಯದ ತೀರ್ಪಿನ ಬಗ್ಗೆ ಗೌರವವನ್ನು ವ್ಯಕ್ತಪಡಿಸುತ್ತಲೇ, ಸಾಮಾಜಿಕ ನ್ಯಾಯದ ವಿಚಾರದಲ್ಲಿ ಅಂದಿನ ಬಿಜೆಪಿ ಸರ್ಕಾರವು ಪೂರ್ವ ತಯಾರಿ‌ ಇಲ್ಲದೆ ಅವಸರದಲ್ಲಿ ಮೀಸಲಾತಿ ಹೆಚ್ಚಿಸಿ ಪರಿಶಿಷ್ಟ ಜಾತಿ ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡಕ್ಕೆ ಮಾಡಿರುವ ಅನ್ಯಾಯವನ್ನು ಖಂಡಿಸುತ್ತೇನೆ. ಬಿಜೆಪಿ ಸರ್ಕಾರದ ಅವಸರದ ತೀರ್ಮಾನವೇ ಇಂದಿನ ಈ ಅವಾಂತರಕ್ಕೆ ಕಾರಣ ಎಂದು ಮಾಜಿ ಸಿಎಂ ಸಿದ್ದರಾಮಯ್ಯ ಹೇಳಿಕೆ ನೀಡಿದ್ದಾರೆ.

The Karnataka High Court's judgment striking down enhanced reservation for Scheduled Castes and Scheduled Tribes is a serious setback to the aspirations of historically marginalised communities. We respect the judiciary. However, the judgment raises fundamental questions about the BJP's handling of social justice. The BJP government increased SC reservation from 15% to 17% and ST reservation from 3% to 7% ahead of the 2023 Assembly elections, despite knowing that total reservation would exceed the 50% ceiling. Why did the BJP announce enhanced reservation without first ensuring its constitutional sustainability? Was electoral advantage prioritised over lasting social justice? The Justice Nagamohan Das Committee, constituted during the Congress government, had provided the foundation for enhancing reservation. This demand emerged from decades of struggle by marginalised communities, not from the political generosity of any party. The BJP-led Union Government subsequently deferred Karnataka's request for Ninth Schedule inclusion, citing the pending litigation. It must now explain what constitutional solution it proposes. My commitment to AHINDA, minorities, backward classes and Dalits, has always rested on one fundamental conviction, which is, political democracy remains incomplete without social and economic equality. Reservation is not charity. It is a constitutional instrument for correcting historical injustice and securing representation. We demand that the Union Government review the 50% ceiling, facilitate a constitutionally sustainable framework for population-informed reservation and reconsider Karnataka's Ninth Schedule proposal. The Karnataka Government must pursue appropriate legal remedies to safeguard enhanced reservation and protect affected students and job aspirants. The struggle for social justice cannot be reduced to election-time announcements. It demands political commitment, constitutional responsibility and lasting institutional reform. Our objective is not merely to promise representation, but to secure it for future generations.

ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಇಂದಿರಾ ಸಹಾನಿ ಪ್ರಕರಣದಲ್ಲಿ ಒಟ್ಟು ಮೀಸಲಾತಿಯು ಶೇ. 50ರ ಮಿತಿಯನ್ನು ಮೀರಬಾರದು ಎಂದು ನೀಡಿದ್ದ ತೀರ್ಪಿನ ಅರಿವಿದ್ದರೂ, ಬಿಜೆಪಿ ಸರ್ಕಾರ 2023ರ ವಿಧಾನಸಭಾ ಚುನಾವಣೆಗೂ ಮುನ್ನ ಪರಿಶಿಷ್ಟ ಜಾತಿ ಮೀಸಲಾತಿಯನ್ನು ಶೇ. 15ರಿಂದ ಶೇ. 17ಕ್ಕೆ ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡ ಮೀಸಲಾತಿಯನ್ನು ಶೇ. 3ರಿಂದ ಶೇ. 7ಕ್ಕೆ ಹೆಚ್ಚಿಸಿದ್ದು ಈಗಿನ ಅವಾಂತರಕ್ಕೆ ಕಾರಣ ಎಂದು ಆರೋಪಿಸಿರುವ ಮಾಜಿ ಸಿಎಂ ಸಿದ್ದರಾಮಯ್ಯ, ಮೀಸಲಾತಿ ಹೆಚ್ಚಳಕ್ಕೆ ಸೂಕ್ತ ಸಾಂವಿಧಾನಿಕ ರಕ್ಷಣೆಯನ್ನು ನೀಡದೆ ಆತುರವಾಗಿ ಜಾರಿ ಮಾಡಿದ್ದೇಕೆ? ಸಾಮಾಜಿಕ ನ್ಯಾಯದ ಪಾಲನೆಗಿಂತ ಚುನಾವಣಾ ಲಾಭವೇ ಬಿಜೆಪಿಗೆ ಮುಖ್ಯವಾಗಿತ್ತೆ? ಎಂದು ಪ್ರಶ್ನಿಸಿದ್ದಾರೆ.

ಕಾಂಗ್ರೆಸ್ ಸರ್ಕಾರದ ಅವಧಿಯಲ್ಲಿ ರಚಿಸಲಾಗಿದ್ದ ನ್ಯಾಯಮೂರ್ತಿ ನಾಗಮೋಹನ್ ದಾಸ್ ಸಮಿತಿಯು ಮೀಸಲಾತಿ ಹೆಚ್ಚಳಕ್ಕೆ ಅಗತ್ಯವಾದ ಬುನಾದಿಯನ್ನು ಒದಗಿಸಿತ್ತು. ಮೀಸಲಾತಿ ಹೆಚ್ಚಳದ ಬೇಡಿಕೆಯ ಈಡೇರಿಕೆಯಾಗಿದ್ದು ಯಾವುದೇ ಪಕ್ಷದ ರಾಜಕೀಯ ಔದಾರ್ಯದಿಂದ ಅಲ್ಲ, ಬದಲಾಗಿ ಅವಕಾಶ ವಂಚಿತ ಸಮುದಾಯಗಳ ದಶಕಗಳ ಹೋರಾಟದ ಫಲವಾಗಿ ಬಂದಿದ್ದಾಗಿದೆ.

ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಕರಣ ಬಾಕಿ ಇರುವ ಕಾರಣವನ್ನೊಡ್ಡಿ, ಮೀಸಲಾತಿ ಹೆಚ್ಚಳವನ್ನು ಸಂವಿಧಾನದ 9ನೇ ಶೆಡ್ಯೂಲ್ ಗೆ ಸೇರಿಸುವ ಕರ್ನಾಟಕದ ಮನವಿಯನ್ನು ಬಿಜೆಪಿ ನೇತೃತ್ವದ ಕೇಂದ್ರ ಸರ್ಕಾರ ತಿರಸ್ಕರಿಸಿತ್ತು. ಹಾಗಾಗಿ ಈಗ ಕೇಂದ್ರ ಸರ್ಕಾರವು ಮೀಸಲಾತಿ ಹೆಚ್ಚಳದ ವಿಚಾರವಾಗಿ ಸಾಂವಿಧಾನಿಕ ಪರಿಹಾರ ಏನು ಎಂಬುದನ್ನು ಕೂಡ ಸ್ಪಷ್ಟಪಡಿಸಬೇಕಿದೆ ಎಂದವರು ಆಗ್ರಹಿಸಿದ್ದಾರೆ.

ಅಹಿಂದ ವರ್ಗಗಳಾದ ಅಲ್ಪಸಂಖ್ಯಾತರು, ಹಿಂದುಳಿದ ವರ್ಗಗಳು ಮತ್ತು ದಲಿತರಿಗೆ ಸೂಕ್ತ ಮೀಸಲಾತಿ ಸೌಲಭ್ಯ ದೊರೆತು, ಅವರು ಸಮಾಜದ ಮುಖ್ಯವಾಹಿನಿಗೆ ಬರಬೇಕು, ಇದರಲ್ಲಿ ಯಾವುದೇ ರಾಜಿಯಿಲ್ಲ. ಸಾಮಾಜಿಕ ಮತ್ತು ಆರ್ಥಿಕ ಸಮಾನತೆಯಿಲ್ಲದೆ ರಾಜಕೀಯ ಪ್ರಜಾಪ್ರಭುತ್ವ ಅಪೂರ್ಣ ಎನ್ನುವುದು ನನ್ನ ದೃಢ ನಂಬಿಕೆ.

ಮೀಸಲಾತಿ ಎಂಬುದು ದಾನವಲ್ಲ. ಇದು ಅನಾದಿ ಕಾಲದ ಅನ್ಯಾಯವನ್ನು ಸರಿಪಡಿಸಲು ಮತ್ತು ಶೋಷಿತ ವರ್ಗಗಳಿಗೆ ಸೂಕ್ತ ಪ್ರಾತಿನಿಧ್ಯವನ್ನು ಕಲ್ಪಿಸಲು ಇರುವ ಒಂದು ಸಾಂವಿಧಾನಿಕ ಸಾಧನವಾಗಿದೆ ಎಂದಿದ್ದಾರೆ.

ಕೇಂದ್ರ ಸರ್ಕಾರವು ಜನಸಂಖ್ಯೆಗೆ ಅನುಗುಣವಾಗಿ  ಮೀಸಲಾತಿ ಹೆಚ್ಚಳವನ್ನು 9ನೇ ಶೆಡ್ಯೂಲ್‌ಗೆ ಸೇರಿಸಲು ಅಗತ್ಯ ಕ್ರಮ ಕೈಗೊಳ್ಳಬೇಕು ಎಂದವರು ಇದೇ ವೇಳೆ ಒತ್ತಾಯಿಸಿದಾರೆ.  

ಹೆಚ್ಚಿಸಲಾದ ಮೀಸಲಾತಿಯನ್ನು ಅದೇ ಪ್ರಮಾಣದಲ್ಲಿ ಉಳಿಸಲು ಹಾಗೂ ನ್ಯಾಯಾಲಯದ ಆದೇಶದಿಂದ ತೊಂದರೆಗೀಡಾಗುವ ವಿದ್ಯಾರ್ಥಿಗಳು ಮತ್ತು ಉದ್ಯೋಗಾಕಾಂಕ್ಷಿಗಳ ಹಿತವನ್ನು ಕಾಪಾಡಲು ಕರ್ನಾಟಕ ಸರ್ಕಾರವು ಸೂಕ್ತ ಕಾನೂನು ಕ್ರಮಗಳನ್ನು ಕೈಗೊಳ್ಳಬೇಕು.

ಸಾಮಾಜಿಕ ನ್ಯಾಯಕ್ಕಾಗಿನ ಹೋರಾಟವನ್ನು ಕೇವಲ ಚುನಾವಣಾ ಸಮಯದ ಘೋಷಣೆಗಳಿಗೆ ಸೀಮಿತಗೊಳಿಸಬಾರದು. ಇದಕ್ಕೆ ರಾಜಕೀಯ ಬದ್ಧತೆ, ಸಾಂವಿಧಾನಿಕ ಹೊಣೆಗಾರಿಕೆ ಮತ್ತು ಶಾಶ್ವತ ಸಾಂವಿಧಾನಿಕ ಸುಧಾರಣೆಯ ಅಗತ್ಯವಿದೆ. ಕೇವಲ ಪ್ರಾತಿನಿಧ್ಯದ ಭರವಸೆ ನೀಡುವುದು ನಮ್ಮ ಉದ್ದೇಶವಲ್ಲ, ಬದಲಾಗಿ ಮುಂದಿನ ಪೀಳಿಗೆಗೆ ಘನತೆಯ ಬದುಕನ್ನು ಕಟ್ಟಿಕೊಳ್ಳಲು ಸೂಕ್ತ ಪ್ರಾತಿನಿಧ್ಯ ಹಾಗೂ ಸಮಾನ ಅವಕಾಶವನ್ನು ಭದ್ರಪಡಿಸುವುದಾಗಿದೆ ಎಂದು ಮಾಜಿ ಸಿಎಂ ಸಿದ್ದರಾಮಯ್ಯ ತಿಳಿಸಿದ್ದಾರೆ.
